I don’t quite get the point to the video. If you are arguing that what they did is illegal, why did the video end there? Where does it show you getting your product back or an apology, or a judge throwing the whole thing out? I’m not saying the store owner is wrong, I’m just not seeing anything in the video where you are later proven to be right.
But the “evidence” was considered legal under state law. A quick search will reveal the product in question was legal even under Mississippi law, which is pretty f’ing strict.
And how many of these seized items even undergo testing? Instead, they are shelved and never heard from again. I have never heard of any problems with the FLAROMA (DaScents) brands and yet they are being pulled from the Mushroom. The reason behind these raids are not public safety or “for the children”, but for much deeper reasons which make Louisiana politics infamous the world over.
He’s just wearing multiple hats as the town’s self-appointed police officer, legislator, health inspector, business consultant, judge, and moral compass. I especially enjoyed the part where he advises the business owner on the name of the business, the price of the goods, and the morality of selling legal items to people. Wake up and tell your Government representatives, that people should be able to exercise their freedoms as they wish as long as they don’t interfere w/ the freedom of others.
In a nutshell they ordered a recall/seizure, for evaluation of product safety. I’m not taking sides or trying to justify actions, they did act in a somewhat questionable manner. But you are kind of advertising this as something it’s not.
Thankfully metaphors don’t apply to the law. Guns are also protected by the second amendment, right to bear arms.

This is a huge problem in the state of Louisiana. We have the highest incarceration rate in the WORLD. Not just the nation, not just North America…the WORLD. People need to rise up and understand their rights. Keep in mind kids, a government big enough to give you everything is big enough to take everything away.
As a resident of Tangipahoa Parish, nothing swells me with pride with some of the rocket surgeons that end up on local law enforcement. Especially in places like Tickfaw.
the cops in this area are some of the most crooked in the country. you wont get a d.w.i. if your family is close to the sheriff or has any power in town. sheriff vernon will let you off just to save paperwork. there is a small few good cops on the force, but there are so many crooked assholes that only got the job to be a bully with a badge&gun.
The law isn’t being violated in this video and the officers were well within their rights… Also the office mentions it was brought across state lines which changes the situation entirely I’m assuming the state it was brought into would be Mississippi, where the ban isn’t on the chemical itself but on ALL “Synthetic cannaboids.” I honestly cannot believe the guy actually believes he has a case.

This Vince Booth guy is sharp, stylistic and aggressive to, he’s keeping the merits of the trial right on the facts, Booth artfully and stylistically leaves out the Fourth Amendment and uses broader Fifth Ammendment language to paint himself out of any open fields stratagy or objective reasonablness assertions that otherwise may apply!!
Last thing:
The Fourth Amendment only protects “persons, houses, papers and effects,” Hester v. US. Open fields do not fall within any of these categories. What does “open fields” exactly mean? Open fields encompass any open, undeveloped property that is not intimately used for dwelling (including curtilage) or business
Also:
Any item that an officer has probable cause to believe is associated with criminal activity that he sees in plain view can be seized without a warrant.
Kind of sucks but case laws shows that everything done here was legal and will more likely than not hold up in court.

The officer can retrieve and secure any evidence found in plain view
No Search warrant needed.
I might be very wrong and I dont really know. But do you have to have a search warrant if you have probable cause?
Like what happens if a cop hears screaming coming from inside a house, they don’t wait until a judge signs a warrant to enter, they go in and help.
